9. Resolution of Disputes

Mandatory Arbitration & Class Action Waiver

Mandatory Arbitration

i. Initiation of Mandatory Arbitration

To address disputes, either party may initiate binding arbitration, subject to the conditions detailed below. Specifically, all disputes stemming from or related to these Terms (including their inception, implementation, or breach), mutual interactions, and/or your use of WhiteChaco Services will be resolved through binding arbitration conducted by the Judicial Arbitration and Mediation Services (“JAMS”) or its successor. This will follow the provisions of its Expedited Arbitration Rules and Procedures or Comprehensive Arbitration Rules and Procedures, explicitly excluding any rules or procedures governing or permitting class actions.

To begin arbitration, you must send a letter requesting arbitration and describing your claim to our designated representative. Contact details for our representative can be found in the “Contact Us” section of our website.

ii. Notification of Disputes

Prior to engaging in arbitration, the disputing party must first notify the other party. Send your notice to: [Your Company’s Legal Address]. This notice should encompass a summary of the dispute, a proposed resolution, and relevant contact information to facilitate communication with our team.

iii. Additional Provisions

Your costs for arbitration and your portion of the arbitrator’s fees will be governed by the JAMS Comprehensive Arbitration Rules and Procedures and, where applicable, the Consumer Minimum Standards, including the current limit on arbitration service fees. The arbitration session will be conducted in your county of residence or employment in the United States, another mutually agreed location, or through telephone or online platforms.

The arbitrator will render a decision within the timeframe specified by the JAMS rules. Any court of competent jurisdiction may enforce the arbitration award. The arbitrator’s authority is limited to awarding declaratory or injunctive relief only to the individual party seeking relief, and only to the extent necessary for providing relief justified by that party’s individual claim.

iv. Class Action Waiver

Both parties consent that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action. Should a claim advance to court instead of arbitration, both parties relinquish any right to a jury trial.

v. Exceptions to Arbitration

Both parties retain the right to pursue legal action specifically for injunctive relief to prevent unauthorized use or abuse of WhiteChaco Services or for intellectual property infringement cases, bypassing the initial steps of arbitration or the described informal dispute resolution process.

WhiteChaco reserves the right to periodically modify and update these Terms of Use. Continuing to use WhiteChaco Services following any changes indicates your acceptance of the revised terms. We are dedicated to keeping users informed about any amendments to these Terms of Use.
